Waste Collection Wimbledon Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Wimbledon provides waste collection and related services to domestic and commercial customers. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

Customer means the person, business or organisation requesting waste collection services.

Company, we, us, our means Waste Collection Wimbledon, the provider of waste collection and related services.

Services means any waste collection, removal, loading, transportation, disposal, recycling or related services supplied by the Company to the Customer.

Waste means any materials, items or substances presented by the Customer for collection, including household waste, commercial waste, bulky items and recyclable materials, but excluding any prohibited waste as defined in these Terms and Conditions.

Booking means a confirmed request made by the Customer for the Company to provide Services at an agreed time, date and location.

2. Scope of Services

The Company provides waste collection and related services for households, landlords, letting agents, businesses and other organisations within our operational service area. The specific Services to be provided will be set out in the Booking confirmation or agreed with the Customer in writing.

The Customer is responsible for ensuring that the requested Services are appropriate for the type and amount of waste to be collected, and for accurately describing the materials to be removed.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any online booking system operated by the Company. All Bookings are subject to availability and to acceptance by the Company.

3.2 When making a Booking, the Customer must provide accurate information including:

The collection address and any access restrictions.

The type, approximate volume, and nature of the waste.

Any items that may be hazardous, heavy, bulky, or require special handling.

The preferred date and time window for collection.

3.3 The Company will confirm acceptance of the Booking and the applicable charges by verbal confirmation, written confirmation, or issue of an invoice. A Booking is only deemed accepted when the Company provides confirmation.

3.4 The Company reserves the right to refuse any Booking, or to cancel or reschedule a Booking where it is not reasonably practicable to provide the Services, including but not limited to operational constraints, safety concerns or non-compliance with these Terms and Conditions.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company has safe, timely and unobstructed access to the waste for the duration of the agreed time window. This includes arranging any necessary parking, keys, gate codes, or permissions and complying with any parking or loading restrictions that may apply.

4.2 The Customer is responsible for:

Ensuring that waste has been stored or presented safely and does not present a risk to health, safety or property.

Separating prohibited or hazardous materials from general waste.

Informing the Company in advance of any items that may require special handling, such as electrical equipment, mattresses, fridges, freezers, tyres or construction waste.

4.3 If the Company is unable to access the waste due to circumstances within the Customer's control, including but not limited to locked premises, incorrect address details, or lack of parking, the Company may charge a missed collection fee or the full service fee at its discretion.

5. Waste Types and Prohibited Materials

5.1 The Company will only collect waste that is lawful for us to transport and dispose of under applicable waste regulations and our licences.

5.2 The Customer must not present for collection any prohibited materials, including but not limited to:

Asbestos, clinical or medical waste, syringes or sharps.

Explosives, ammunition, gas bottles or pressurised containers.

Corrosive, flammable, toxic or otherwise hazardous chemicals.

Radioactive materials or any substances classified as hazardous waste unless previously agreed and permitted by law.

5.3 The Customer must disclose to the Company any waste that may be hazardous, regulated or subject to special controls. If such waste is accepted, it will only be collected and managed in accordance with applicable regulations and may be subject to additional charges and special documentation.

5.4 If prohibited or undisclosed hazardous waste is presented for collection, the Company may refuse to collect it, may cancel the Booking, or may make additional charges for handling, returning or safely managing the item. The Customer will be responsible for any costs, claims or liabilities arising from the incorrect description or unlawful presentation of waste.

6. Pricing and Payment

6.1 Prices for Services are based on factors including waste type, estimated volume or weight, labour required, access conditions and disposal or recycling costs. The Company may provide an estimated price before collection, which is subject to inspection of the waste on arrival.

6.2 If the actual volume, weight or nature of the waste differs from the information provided at the time of Booking, the Company may adjust the price accordingly. The operative will inform the Customer of any change in price before proceeding. If the Customer does not agree to the revised price, the Company may cancel the Service and may charge a call-out or cancellation fee.

6.3 Unless otherwise agreed in writing, payment is due on or before completion of the collection. The Company accepts payment methods as communicated to the Customer at the time of Booking, which may include card payment, bank transfer or cash.

6.4 For account Customers and commercial contracts, payment terms will be specified in the invoice or contract. If no specific term is stated, payment is due within 14 days of the invoice date.

6.5 The Company reserves the right to charge interest on late payments at the statutory rate permitted under UK law, as well as reasonable debt recovery costs.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a Booking by giving notice to the Company. Where possible, the Company will accommodate any requested changes.

7.2 If the Customer cancels a Booking more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless specific non-refundable costs have been incurred by the Company.

7.3 If the Customer cancels a Booking within 24 hours of the scheduled collection time, or fails to provide access at the agreed time, the Company may charge a cancellation or missed collection fee, up to the full amount of the agreed service price.

7.4 The Company may cancel or reschedule a Booking due to operational reasons, vehicle breakdown, severe weather, safety concerns, or circumstances beyond its reasonable control. In such cases, the Company will attempt to notify the Customer as soon as practicable and offer an alternative time or a refund of any pre-paid charges. The Company will not be liable for any indirect or consequential losses arising from such cancellation or rescheduling.

8. Performance of Services

8.1 The Company will use reasonable care and skill in providing the Services and will comply with applicable UK waste management regulations and duty of care obligations.

8.2 All waste collected by the Company will be transported to authorised facilities for transfer, recycling, recovery or disposal, in accordance with legal requirements and the Companys environmental policies.

8.3 On completion of the collection, responsibility for the waste transfers from the Customer to the Company. The Company will maintain appropriate records required by law, such as waste transfer notes, which may be provided to the Customer on request where relevant.

9. Customer Warranties

9.1 The Customer warrants that:

They are the owner of the waste or have full authority from the owner to arrange its collection and disposal.

The waste to be collected is accurately described and does not contain undisclosed prohibited or hazardous materials.

All documentation and information supplied to the Company is complete, accurate and not misleading.

9.2 The Customer agrees to indemnify and keep the Company indemnified against all liabilities, costs, claims, damages and expenses arising from any breach of these warranties, including any breach of waste regulations attributable to incorrect information or unlawful waste presented by the Customer.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.

10.2 Subject to the above, the Company will not be liable for:

Any indirect, special or consequential loss or damage.

Loss of profits, revenue, business, goodwill or anticipated savings.

10.3 The Companys total liability arising under or in connection with the provision of the Services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.4 The Customer is responsible for ensuring that access routes, driveways, surfaces and structures are suitable for vehicles and operatives. The Company will take reasonable care but will not be liable for damage to surfaces, underground services or property where access has been requested or permitted by the Customer and the damage could not reasonably have been avoided.

10.5 The Customer must notify the Company in writing of any claim or complaint relating to the Services within 7 days of the collection date. The Company may request evidence or further information in order to investigate and respond.

11. Compliance with Law and Waste Regulations

11.1 The Company will carry out all Services in compliance with applicable UK laws relating to waste management, including duty of care requirements, licensing and transport regulations.

11.2 The Customer agrees to co-operate with the Company and to provide any information reasonably required to enable compliance with legal obligations, including details of the origin, nature and composition of the waste.

11.3 Where required by law, the Customer and the Company will complete and retain appropriate waste transfer documentation. The Customer must keep its copy for the period required by law.

12. Force Majeure

12.1 The Company will not be liable for any failure or delay in performing its obligations where such failure or delay is due to events beyond its reasonable control, including but not limited to extreme weather, strikes, lockouts, industrial disputes, accidents, road closures, acts of God, war, terrorism, breakdown of plant or machinery, or compliance with any law or governmental order.

12.2 In such circumstances, the Company may suspend the Services for the duration of the event or offer to reschedule the Booking.

13. Data Protection and Privacy

13.1 The Company may collect and process personal data relating to the Customer, such as contact details and service records, for the purpose of providing the Services, maintaining records, handling payments and meeting legal obligations.

13.2 Personal data will be handled in accordance with UK data protection laws. The Company will take reasonable steps to safeguard personal information and will not share it with third parties except where necessary to deliver the Services, process payments, comply with legal duties or with the Customers consent.

14. Variation of Terms

14.1 The Company may amend these Terms and Conditions from time to time. The version in force at the time of Booking will apply to that Booking.

14.2 Any variation to these Terms and Conditions requested by the Customer will only be effective if agreed in writing by an authorised representative of the Company.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions, together with any Booking confirmation or written agreement, constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior understandings or arrangements.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
